Alan Rubel argues that envelope-pushing interpretations of surveillance law are problematic because they may undermine legal archetypes (limits on what the law may do) because they implicate basic rights, because there is insufficient reason to think that they will be beneficial enough to override rights, and because the secrecy of legal interpretation underwriting the surveillance practices hinders them from being reconciled with a system of laws more broadly.
